The wife of former Green Bay Packer Julius Peppers and five other professional models sued a Las Vegas nightclub for allegedly using their images and likenesses to promote the business on social media.
Claudia Sampedro and five other models allege Cawacha Entertainment LLC, doing business as Mango Tango Nightclub, used images of them to create the false impression that they worked for, promoted, or endorsed the club, according to the complaint filed Wednesday in the U.S. District Court for the District of Nevada.
The misappropriation and publication of the models’ images was done without their knowledge or consent and without compensation in violation of federal trademark and state laws, they allege.
The women allege the club posted their images and likenesses multiple times on its Facebook account and Twitter page.
Sampedro has appeared as a model in catalogs and magazine editorials and is a sponsored model for Nutri Sups Nutrition, according to the complaint.
The other plaintiffs are Denise Milani, also known as Denise Trlica; Jessica Hinton, also known as Jessa Hinton, Paola Canas, Rosie Wicks, also known as Rosie Jones, and Sandra Valencia.
Causes of Action: Lanham Act, Nevada’s Right of Publicity Statute, negligence, common law unfair competition/misappropriation, deceptive trade practices.
Relief: Injunctive relief, damages, attorneys’ fees and costs.
Response: The nightclub didn’t immediately respond to a request for comment.
