A Tuscon, Ariz., strip club violated seven models’ right to control commercial use of their likeness by using their pictures in ads without permission, an Arizona federal court said.
Ten’s Strip Club failed to prove Arizona law doesn’t protect the models’ right of publicity or that it was subject to a one-year statute of limitations, the U.S. District Court for the District of Arizona said.
The court awarded summary judgment on right of publicity liability, but the models lost other state and federal claims while federal false endorsement claims will proceed to trial.
