Cucina & Amore ‘No Preservatives’ Labeling Suit Dismissed

A suit alleging specialty Italian food purveyor Cucina & Amore Inc. deceptively marketed more than a dozen products as having “no preservatives” has been dismissed, according to a filing in federal court in California.

Mark Flolo, seeking to represent a nationwide class, alleged the company’s pesto, artichoke hearts, and other goods are misleadingly labeled because they contain citric acid or ascorbic acid, which the Food and Drug Administration classifies as preservatives.

Cucina & Amore said consumers wouldn’t be fooled by the labels and urged the U.S. District Court for the Northern District of California to throw out the suit.
