Cucina & Amore Hit With Label Suit Over Preservatives

Specialty Italian food purveyor Cucina & Amore Inc. was hit with a proposed class suit alleging it deceptively markets more than a dozen products.

Pesto, artichoke hearts, and other goods are misleadingly labeled “no preservatives” when they contain citric acid or ascorbic acid, Mark Flolo says on behalf of a nationwide class.

The Food and Drug Administration classifies both substances as preservatives, Flolo alleges.

The company’s marketing violates the consumer protection laws of all 50 states, he says in a complaint in the U.S. District Court for the Northern District of California.
