Cucina & Amore Disputes Challenge to ‘No Preservative’ Labeling

Consumers aren’t fooled by “no preservative” labeling on pesto, artichoke hearts, and other goods made by Cucina & Amore Inc. and it should be granted judgment in a proposed class suit, the specialty food maker told the Northern District of California.

Mark Flolo, who seeks to represent a nationwide class, alleges the labeling is deceptive because the foods contain citric acid or ascorbic acid, both of which are classified as preservatives by the Food and Drug Administration.

But the ingredients have multiple uses, including as flavor enhancers and to control food acidity, the specialty Italian food purveyor said.
