Amazon Case Arguments at 3d Cir. Limited to ‘Seller’ Liability

Oral argument in an injured Pennsylvania woman’s suit against Amazon.com Inc. will be limited to whether the company is a “seller” subject to product liability claims under state law, the full Third Circuit said Dec. 3.

That means that neither Amazon’s nor plaintiff Heather Oberdorf’s attorneys will field questions about whether the federal Communications Decency Act immunizes Amazon from suit for sales on its “marketplace.”

The U.S. Court of Appeals for the Third Circuit may consider the materials it has already, including the parties’ briefs to the three-judge panel, which discussed the CDA.
