Amazon Not a ‘Seller’ Under National Court Consensus, It Says

Recent court decisions have created a “national consensus” that Amazon.com, Inc. isn’t a seller of products offered on its web marketplace, the company told the full Third Circuit in a product liability suit.

And the federal appeals court would overstep its bounds if it finds that the company is a seller under Pennsylvania law, as a prior three-judge panel said. That’s because such a holding would extend existing state law, it says.
