Amazon Should Face ‘Marketplace’ Liability, Injured Woman Says

A panel of the Third Circuit didn’t overstep its bounds when it held Amazon.com Inc. qualifies as a “seller” subject to liability under Pennsylvania law for transactions on its web marketplace, a woman injured by an allegedly defective pet product told the full appeals court.

Pennsylvania Supreme Court decisions have defined a “seller” as “anyone who enters into the business of supplying human beings with product,” Heather Oberdorf and her husband say in a Nov. 13 brief. Amazon did just that, the Oberdorfs argue.
