Louisiana Ten Commandments Order Gets Another Fifth Circuit Look

Louisiana’s requirement that the Ten Commandments must be displayed in its public schools will get a second look from the US Court of Appeals for the Fifth Circuit, which granted a request for en banc review Monday.

Three Fifth Circuit judges said in June in a now vacated opinion that the embattled rule is “plainly unconstitutional” and that the lower court’s decision to preliminarily enjoin the law wasn’t in error. They noted that the Supreme Court already reviewed a similar rule in Stone v. Graham and said it violated the Establishment Clause.
