Louisiana’s law requiring its public schools to display the Ten Commandments will remain blocked following a ruling Friday by the US Court of Appeals for the Fifth Circuit.
The law, H.B. 71, “is plainly unconstitutional,” despite recent changes in US Supreme Court precedent on the Establishment Clause, the appeals court said.
The case is the latest flash point following the Supreme Court’s change in how it views such cases in Kennedy v. Bremerton School District, which said courts should focus on what the Founders would’ve considered inappropriate rather than the more stringent Lemontest.
