Louisiana will urge the Fifth Circuit Thursday to lift a preliminary injunction that bars it from enforcing a law requiring the Ten Commandments be displayed in public school classrooms.
A lower court said the display requirement was unconstitutional facially and as applied, violating the US Constitution’s First Amendment.
The law, and Louisiana’s turn to the US Court of Appeals for the Fifth Circuit, have garnered support from 18 other states, some of which may adopt similar measures in light of the US Supreme Court’s 2022 shift in how it views Establishment Clause cases.
