OpenAI, IYO Secure Expedited Appeal Of ‘IO’ Trademark Ban Order

The Ninth Circuit agreed to fast-track an appeal from OpenAI Inc. and a hardware startup it owns challenging a temporary ban on their use of the “io” trademark in an infringement lawsuit brought by IyO Inc.

OpenAI and Io Products Inc.'s opening brief is due July 24 and IyO’s answering brief is due August 14, according to an order issued Thursday in the US Court of Appeals for the Ninth Circuit. The court set oral argument for November, which it said was the next available calendar date.
