Micron Declaratory Action Dismissed After YMTC Filed First

Micron Technology Inc. failed to convince a California federal judge to keep its declaratory action intact after Chinese competitor Yangtze Memory Technologies Co. beat it to court with patent infringement allegations filed in Texas.

The first-to-file rule permits the court to dismiss Micron’s case, Judge Vince Chhabria said in a Wednesday order filed in the US District Court for the Northern District of California. YMTC filed patent infringement allegations against Micron on Oct. 6, and Micron filed its declaratory action in California on Oct. 7.
