Industry Groups Can Join 24 States Challenging Biden WOTUS Rule

Nearly 20 industry groups can join a coalition of states challenging the Environmental Protection Agency’s new Waters of the United States rule, a federal magistrate judge ruled.

The American Farm Bureau Federation, American Petroleum Institute, and other groups have already filed their own separate suit in an attempt to strike down the Biden administration’s revised definition of WOTUS—which extends Clean Water Act protections to wetlands and smaller bodies of water.

Their suit was later consolidated with a separate WOTUS complaint filed by Texas. A federal judge overseeing the Texas suit issued a preliminary injunction against the 2023 WOTUS rule ...
