Industry Groups Challenge Biden Waters Rule in Federal Lawsuit

The American Farm Bureau Federation, American Petroleum Institute, and other industry groups sued the federal government in an attempt to strike down the Biden administration’s revised definition of Waters of the United States, the same day Texas Attorney General Ken Paxton (R) filed a similar suit.

The revised rule, which roughly reinstates a pre-2015 rule for waters of the US, or WOTUS, extends Clean Water Act protections to wetlands and smaller bodies of water, giving more jurisdiction to clean up smaller bodies of water which put larger bodies of water at risk of contamination.
