Texas Attorney General Challenges Biden Waters Rule in Lawsuit

Texas Attorney General Ken Paxton (R) sued the Environmental Protection Agency and Army Corps of Engineers Wednesday in an attempt to strike down the Biden administration’s new definition of Waters of the United States.

The rule strengthens Clean Water Act protections by extending them to wetlands and smaller bodies of water. It was released at the end of December and published in the federal register Wednesday.

Paxton claims that the new definition is an attempt for the Biden administration to overstep the limits of its jurisdiction and assert federal control over state land. The new definition subjects land with isolated ...
