Jack in the Box, Workers Get Mixed Decision in Wage Case Appeal

Jack in the Box Inc. and some of the hamburger chain’s Oregon workers both secured new looks at decisions favoring the other side in their wage-and-hour dispute, the Ninth Circuit said Tuesday after ruling on cross-appeals.

The workers nabbed summary judgment below on claims that Jack in the Box over-deducted their wages for a benefit fund, and the fast food brand landed post-trial relief on claims that it improperly deducted shoe costs from their pay. The lower court got both of those decisions wrong, the US Court of Appeals for the Ninth Circuit said.
