Jack In The Box Worker Class Wins on Paycheck, Deductions Claims

Jack In The Box acted carelessly in over-withholding workers’ benefit fund amounts from their paychecks and failing to timely issue final paychecks after selling their Oregon restaurants to franchisees, a federal court in Oregon ruled.

The court Nov. 13 granted the workers’ summary judgment motions on those claims but held that workers’ separate claims over the company’s in-house shoe-purchasing program would continue to be litigated.

Jessica Gessele and four other workers are suing Jack In The Box, Inc., which owned and operated several restaurants in Oregon that were sold to various franchisees between May 2006 and September 2011.
