- Marc Elias, a longtime Democratic lawyer and campaign attorney for Kamala Harris, is preparing a team of more than 75 lawyers to sue for ballot recounts in swing states if Donald Trump is reelected as president. Elias has already filed more than 60 preelection lawsuits to combat what he calls Republican “voter suppression” efforts. (RealClearInvestigations)
- Neal Katyal, a partner at Hogan Lovells and former US Acting Solicitor General, said at the Fortune Impact Initiative Summit that companies are “caving” to criticism of DEI policies because “they’re wimps.” He said he doesn’t believe all businesses need to have a diversity program, but he takes issue with employers who use the Supreme Court’s ruling on affirmative action as an excuse for watering down their own programs in fear of legal challenges. (Fortune)
- Robert Serafinowicz, a Connecticut lawyer, received a year-long suspension for slapping fellow attorney Edward Gavin in front of a courthouse and for a separate “destructive and harmful campaign of harassing behavior” against a former friend. The slap caused a contusion and bleeding from Gavin’s ear. (ABA Journal)
