A company that twice missed out on a government contract for helicopter flight training services lost its bid for another chance after the Federal Circuit Thursday rejected arguments the U.S. Army’s improper handling of the award prejudiced it.
System Studies & Simulation Inc., also known as S3, argued that there’s a presumption of prejudice whenever the U.S. Court of Federal Claims finds an agency “acted irrationally” in awarding a contract. “We reject that contention,” the U.S. Court of Appeals for the Federal Circuit said.
