Papa John’s Driver Revives Arbitration Fight in Wage Case (1)

A former Papa John’s delivery driver who swore he had never seen the arbitration agreement bearing his electronic signature can try again to keep his wage claims in federal court, the Sixth Circuit said Thursday.

The driver’s testimony that he never saw the agreement was enough to create a genuine dispute as to whether he signed it, so the lower court shouldn’t have granted Papa John’s motion to compel arbitration, the US Court of Appeals for the Sixth Circuit said.
