Office Depot Worker Advances California Wage-and-Hour Claims

An Office Depot worker’s fourth amended complaint finally provided enough detail about his wage-and-hour allegations to get his proposed class action past the dismissal stage, a federal judge in California said.

The worker’s one-day delay in meeting the court’s filing deadline isn’t a good reason to throw out the suit, which otherwise adequately pleaded minimum wage, overtime, meal and rest break, and other wage claims, the US District Court for the Eastern District of California said in an order docketed Wednesday. The court in February gave the worker “one final chance” to advance his case.
