Mondelez Must Wait to Contest BelVita Class Certification Grant

Mondelez International Inc. lost its bid for a quick appeal of a ruling that granted class status to California and New York consumers who allege it deceptively portrays high-sugar belVita breakfast biscuits as healthful, according to a Ninth Circuit order.

Patrick McMorrow, Marco Ohlin, and Melody DiGregorio challenge statements that belVita products would provide “nutritious sustained energy,” “nutritious steady energy all morning,” and similar phrases.

Their petition for class certification was granted in March by the U.S. District Court for the Southern District of California, which said they showed their alleged damages could be established classwide.
