Labor Agreement Ban Guarantee Needed From Court, Contractor Says

Contractor Hensel Phelps Construction Co. is asking a federal court to permanently enjoin the US government from using project labor agreements in contract procurements, because it said a January ruling finding those agreements violate competition rules is insufficient.

The government responded to the court’s decision by implementing temporary corrective actions in contract competitions, but that offers “no guarantee against future violations,” Hensel Phelps told the US Court of Federal Claims Tuesday, in response to the government’s assertion that their dispute is moot.
