Justices Pass Up Case Questioning Device Searches at U.S. Border

The U.S. Supreme Court won’t review U.S. border security officials’ ability to search travelers’ mobile phones and other digital devices without a warrant.

The court declined in a Monday order to take up a case that asks whether such searches raise constitutional concerns under the Fourth Amendment’s privacy protections.

Digital and civil rights groups brought the case to the Supreme Court on behalf of several U.S. citizens who sued the Department of Homeland Security over border searches of their mobile phones, laptops, and other devices.
