Judiciary Deadlocks on District Court Pick, Advances Five Others

A nominee to a California district court received a tie vote in the Senate Judiciary Committee, creating an additional step for her nomination, while five other judicial nominees advanced.

Kenly Kiya Kato, who is nominated to the U.S. District Court for the Central District of California, received an 11-11 party line vote on Thursday.

While Kato won’t be reported favorably out of the committee, the full Democratic-led Senate can advance her nomination to consideration on the floor through a discharge vote. Two of Biden’s judicial nominees have been confirmed after such a vote.

The committee advanced five other judicial nominees, including the Innocence Project’s Nina Morrison, who is nominated to the Eastern District of New York.

Morrison advanced by a 12-10 vote, winning support from Sen. Lindsey Graham (R-S.C.). Graham, the immediate past Judiciary Committee chair, has supported advancing the majority of Biden’s judicial nominees to the Senate floor.
