‘Joint Juice’ $32 Million Supplement Suit Properly Dismissed

Post Holdings Inc. unit Premier Nutrition Corp. was properly granted judgment in a false ad suit seeking $32 million in equitable restitution for allegedly duped diet supplement consumers, the Ninth Circuit said Wednesday.

Kathleen Sonner alleged Premier’s “Joint Juice” glucosamine product didn’t live up to promises of pain relief. A California class was certified in 2016.

On the brink of trial, Sonner voluntarily dismissed her state-law claim for legal damages and sought to proceed solely with claims for equitable-relief restitution, under California’s Unfair Competition Law and Consumers Legal Remedies Act.
