Issue:
Are Uber drivers a class of workers engaged in foreign or interstate commerce for purposes of the employment contract arbitration exemption in the Federal Arbitration Act? A district court in New York notes that the Second Circuit hasn’t addressed the issue, but that the Ninth and First circuits say they aren’t, while the Seventh Circuit says that drivers who occasionally transport loads interstate qualify for the exemption.
