The Ninth Circuit seemed open Monday to reviving a lawsuit that challenged an Arizona law banning abortions when sought solely because an embryo or fetus tested positive for a genetic abnormality.
The merits of the law’s constitutionality wasn’t at issue, as the lower federal court had dismissed the suit after finding that the plaintiffs lacked standing. The plaintiffs, on appeal, asked the US Court of Appeals for the Ninth Circuit to reinstate their claims that the law was unconstitutionally vague because it didn’t sufficiently notify doctors of what conduct it prohibits.
