Dentsply Investors Advance Byte Teeth Aligner Injury Claims

Dentsply Sirona Inc. must battle investor claims that it misrepresented the success of its invisible teeth straighteners while selling them to “unqualified, contraindicated” patients and of underreporting thousands of serious injuries.

The investors leading the case sufficiently alleged certain executives knowingly or recklessly misrepresented dentist-overseen care and other issues with its since-dropped Byte aligners, Judge Naomi Reice Buchwald said.

Executive departures after revelations arose about Byte patient injuries and regulatory underreporting supported an inference of conscious misbehavior, the US District Court for the Southern District of New York said, partially dismissing the proposed class action.
