3D Printer Company’s Investor Fails to Revive Securities Suit

An investor was unable to to convince a federal appeals panel to revive her securities fraud claims against Desk Metal Inc. on Monday.

Sophia Zhou can’t pursue a scheme liability claim and failed to allege that any of Desktop Metals challenged statements were either materially false or misleading, the US Court of Appeals for the First Circuit said in an opinion. A three-judge panel unanimously affirmed the September 2023 dismissal of the proposed class action Zhou and other investors brought against the 3D printer manufacturer, alleging securities fraud.
