Safety Panel Voids Part of Fuel-Tank Cleaning Company Fine

The Occupational Safety and Health Review Commission has voided a $6,600 fine against Clean Fuels of Indiana, Inc., after a 2014 fatality at a Florida gas station.

An administrative law judge assessed the fine under OSHA’s general industry standards even though the accident took place while the RaceTrac gas station and convenience store was under construction in December 2014, the commission said. Though the judge fined Clean Fuels a total of $11,600 for safety violations, only the $6,600 fine under the general industry standards was reviewed in the commission’s decision.
