The maker of Red Dawn and Sleep Walker energy supplements shed a proposed class suit alleging it fails to disclose the presence of phenibut, an unapproved food additive that can cause dizziness and trouble breathing, according to a federal court in New York.
Duane Womack alleged that EVOL Nutrition Associates Inc., which does business as Red Dawn Energy, deceptively markets its products, violating New York consumer protection law. He said he experienced dizziness and nausea after using the supplements.
