Red Dawn Energy Drink Consumer Deception Lawsuit Tossed, for Now

Evol Nutrition Associates Inc. shook off, for now, a proposed class suit alleging it fails to disclose that its energy supplements contain an ingredient that can cause dizziness and trouble breathing, a New York federal court order said.

Duane Womack alleges the company, which does business as Red Dawn Energy, deceptively markets its “Sleep Walker”and “Red Dawn” products, violating New York consumer protection law.

Womack alleges the energy drinks contain Beta-phenyl-gamma-aminobutyric acid, otherwise known as phenibut or GABA.
