Polar Beverages Avoids ‘100% Natural’ Deception Suit For Now

Polar Beverages escaped, at least temporarily, a proposed class action alleging it falsely advertises its line of “100% Natural” seltzers as free from synthetic ingredients.

Although the consumers adequately alleged the seltzers contain ocimene quintoxide, “the mere identification of one synthetic in some product is not sufficiently specific to satisfy pleading requirements,” since the complaint doesn’t identify which flavors they tested, Judge Edward M. Chen of the US District Court for the Northern District of California said in a Monday order dismissing the suit. The plaintiffs have until Sept. 22 to file an amended complaint.
