Health-Ade LLC struck back at a proposed class action alleging it deceptively portrays kombucha as healthful when it has a high sugar content, telling a California federal court consumers couldn’t possibly be misled, in part because the fermented beverage—by definition—is made with sugar.
Californians Brandon Johnson-Jack and Michael Xavier alleged the brand “Health-Ade” conveys the misleading message that the drinks “aid health,” and said the company’s marketing has helped its products become the fastest-selling kombucha in America.
