Wyndham Capital Mortgage Wins Bid to Dismiss Phishing Lawsuit

Wyndham Capital Mortgage Inc. successfully swatted down claims that it acted negligently and violated trade practices law after it suffered a phishing scam that allegedly leaked the personal and financial information of some customers.

Plaintiff Ethan Darnell’s lawsuit against the home loan provider is dismissed because he failed to demonstrate the injury-in-fact required to bring claims in federal court, Judge Frank D. Whitney wrote in an order filed Wednesday in the U.S. District Court for the Western District of North Carolina.

Attorneys representing Darnell didn’t immediately respond to a request for comment.
