Wyndham Capital Mortgage Inc. should be held liable for its role in a phishing scam that exposed customers’ personal and financial information, the plaintiff in a proposed class action argues.

The Charlotte, N.C.-based company acted negligently and violated state trade practices law when it failed to safeguard the data from the breach, according to the plaintiff in a lawsuit filed Thursday in the U.S. District Court for the Western District of North Carolina.
