Nike Trims Invasion of Privacy Claims in Proposed Class Action

Nike Inc. shed claims it violated users’ privacy after a California federal judge found the complaint didn’t plead any facts suggesting the sportswear giant collected intimate or sensitive personally identifiable information.

Nike and third-party partner FullStory Inc.'s alleged collection of online shoppers’ mouse clicks, keystrokes, and user location isn’t enough to constitute a “serious invasion of a protected privacy interest,” Judge Fernando L. Aenlle-Rocha wrote in an order filed Sept. 27 in the U.S. District Court for the Central District of California.

Attorneys representing plaintiff Burhaan Saleh didn’t immediately respond to a request for comment.
