Supreme Court Declines Case Over Alleged Emergency Law Violation

A Kansas man won’t get to argue before the US Supreme Court that calling in a nonphysician to evaluate his emergency medical condition violated federal law, after the justices declined Monday to review his case.

Ricky Koel claimed that Colby, Kan.-based Citizens Medical Center failed to properly screen and stabilize his eye injury as required by the federal Emergency Medical Treatment and Labor Act, resulting in his loss of vision in that eye.
