Eye Injury Patient Fails to Revive Emergency Care Law Claim

A Kansas man can’t proceed with a federal lawsuit alleging that a hospital failed to properly screen and stabilize him following an eye injury, the Tenth Circuit said Monday.

Colby, Kan.'s Citizens Medical Center provided all the services and care it was capable of when Ricky Koel went to its emergency room after sustaining serious injuries to his eye, the US Court of Appeals for the Tenth Circuit said. The hospital didn’t have an eye specialist on staff and wasn’t capable of treating a non-obvious injury, Judge Timothy M. Tymkovich said.
