Wynn Casino Server Accepts Judge’s FMLA Damages Cut, Ending Case

A former Wynn Las Vegas LLC cocktail server accepted a reduced award of $20,478 for interference with her Family and Medical Leave Act rights, avoiding a new trial on damages.

The US District Court for the District of Nevada ruled July 29 that the trial evidence supported a finding that the employee’s leave played a negative role in her termination, but that the $321,200 a jury awarded her was excessive. The ruling gave her the choice of accepting the reduced amount, plus $6,723 in prejudgment interest, or facing a re-trial on the proper amount.
