Three Welch Foods Inc. grape beverage consumers have voluntarily dismissed a lawsuit alleging two products were deceptively portrayed as having no artificial flavors, signaling a settlement, court filings show.
Jessica Augustine, Adriane McCloria, and Matthew Rutledge sued Welch’s in February. They challenged the labeling of “Light Concord Grape Juice Beverage” and “Light White Grape Juice Beverage.”
The products were marketed as having no artificial flavors despite the inclusion of a synthetic form of malic acid, which imparts a tart flavor, they alleged in a proposed class action.
