WanaBana LLC and WanaBana USA LLC told a federal court it should reject parents’ motion to remand a suit alleging the companies’ cinnamon-flavored applesauce pouches contained lead.
The WanaBana entities complied with the removal pleading requirements so the suit should stay in state court, they argued in their opposition to the motion filed March 22 in the US District Court for the Southern District of Florida. The companies say the federal removal statute and case law only requires a short statement of the grounds for removal, which they provided.
