Parents suing WanaBana LLC and WanaBana USA LLC, the makers of pureed fruit products including cinnamon-flavored applesauce pouches, say their lawsuit should be remanded to Florida state court because the companies didn’t adequately show diversity of citizenship.
The WanaBana entities removed the Windham family’s December 2023 suit to the US District Court for the Southern District of Florida because their members are Ecuadorian and Puerto Rican citizens. The Florida parents want the case remanded to the Circuit Court of the Eleventh Circuit for Miami-Dade County.
