Trump-Appointed Judges Rebuke Denial of Covid-19 Bias Rehearing

Several Trump-appointed circuit judges criticized the Ninth Circuit’s refusal to re-hear a Christian woman’s religious discrimination suit Wednesday, contending the court is impermissibly opining on the veracity of her belief, committing legal error, and breaking from other circuit precedent.

The growing conservative cohort on the historically liberal circuit has recently hit back at various of the court majority’s denials of both panel and en banc re-hearings regarding various constitutional matters. Eighth Republican-appointed Ninth Circuit judges criticized a decision in March not to revisit a ruling removing qualified immunity for police officers based on the Fourth Amendment’s “hot pursuit” exception.
