Thomas J. Henry PLLC, a large personal injury firm in Texas, says it didn’t discriminate against a former employee who claims she was demoted after being sexually assaulted by the firm’s chief executive officer.
The firm on Monday asked a federal judge in the US District Court for the Western District of Texas to fully dismiss the case on the grounds that an alleged victim of assault is “neither a protected class nor itself a protected activity.”
