A consumer who said he overpaid for a Lasko Products LLC’s space heater failed to cite any allegedly misleading statements that he relied on for his purchase, a federal judge said.
Without identifying allegedly misleading statements about the space heater, the consumer didn’t have a factual issue that could drive his lawsuit to trial, the US District Court for the Southern District of New York said Monday. Judge Jennifer L. Rochon also rejected the argument that a hypothetical analysis could show a price-premium injury. She granted summary judgment to Lasko and closed the case.
