Shrinking Crocs Consumer Deception Suit Gets Booted Out of Court

Crocs Inc. won summary judgment on a consumer’s proposed class action alleging the footwear company failed to tell consumers that its Croslite polymer shoes could shrink in extreme heat.

Crocs prevailed in this “shoe shrinking croc-nuundrum” because plaintiff Ruby Cornejo didn’t identify what specific advertising statements she relied on that made her believe the company guaranteed the shoes wouldn’t shrink, Judge Trina L. Thompson of the US District Court for the Northern District of California said Monday.
