Customers Miffed Over Shrinking, Weathered Crocs Keep Suit Alive

Crocs Inc. failed to convince a federal judge to toss a proposed class action accusing the company of knowingly selling shoes it advertised as all-weather even though they shrank after prolonged exposure to sunlight and water.

The consumers’ second complaint adequately listed advertisements portraying the shoes in hot, wet, and sunny conditions, so they can proceed with their lawsuit, the US District Court for the Northern District of California said Monday. Their previous complaint lacked details about which complaints the plaintiffs had seen and when, but they rectified that in the amended complaint, Judge Trina L. Thompson said.
